The Supreme Court eight-member bench on Saturday issued clarification on the applications moved by Election Commission of Pakistan and Pakistan Tehreek-e-Insaf (PTI).
The judges of the majority verdict said that there was no ambiguity in the verdict given on July 12.
The judges said that July 12 verdict is quite clear, and the Election Commission of Pakistan unnecessarily made it complicated.
The clarification also warned that noncompliance with the verdict would lead to serious consequences.
Barrister Gohar was accepted as Chairman of PTI while Omar Ayub as secretary General in the verdict, it said.
The SC judges said that the successful candidates belonged to the PTI.
The judges also said that the attempt to create complications and to create confusion about the clear order is rejected hereby.
“There could be serious consequences over complete failure or denial as issuing a list is an administrative matter,” said the judges.
It asked the ECP to fulfil its responsibility .
The clarification said that the ECP had accepted this fact that the PTI is a registered political party. It held that it is wrong to reject the certificate of the PTI candidate.
“The ECP may face legal and constitutional consequences over such things,” said the judges in clarification.
All candidates submitting certificates would be deemed of the PTI and there would be impact on the national as well as the provincial assemblies.
The Supreme Court ordered the ECP to enforce the verdict, holding that depriving a party of electoral symbol does not end its rights.
“PTI was and is a political party and it also secured seats in the elections,” said the clarification.
The ECP”s attempt to seek clarification is tantamount to create hurdle in implementation of the Supreme Court verdict, it said.
It may be mentioned here that Justice Syed Masoor Ali Shah, Justice Athar Minallah, Justice Ayesha A. Malik, Justice Muhammad Ali Mazhar, Justice Hasan Rizvi, Justice Shahid Waheed and Justice Irfan Saadat were the judges of the Supreme Court.
