Jamaat-e-Islami Pakistan has challenged the 26th constitutional amendment in Sindh High Court (SHC).
JI Emir Hafiz Naeem ur Rehman moved the petition before the court through his lawyers, He appealed the court declare it as void.
The petition requested the court declare the formation of the Judicial Commission also ultra vires. It also sought formation of parliamentary committee and appointment of the Chief Justice through it as against the spirit of the constitution.
It is the third petition filed before the SHC against the recent amendment in the constitution. The amendment authorised the prime minister to choose the chief justice among three senior judges of his own choice. The parliamentary committee will forward the names of the three judges to the prime minister.
The Pakistan Tehreek-e-Insaf (PTI) and a private person have already moved to the SHC against the amendment.
Lahore High Court Bar Association (LHCBA) has moved to the Supreme Court against the amendment. It filed the petition before the top court through senior lawyer Hamid Khan. He also led the Professional Group of lawyers which won the LHCBA polls.
Hafiz Naeem ur Rehman is vocal against the 26th constitutional amendment, frequently declaring it as an assault on the SC. He said the government through this amendment tried to control the judiciary. He claimed the government lacks mandate and have no right to bring about changes to the constitution, a unanimous document adopted by the political parties in 70s. He said the ruling parties came to power through worst rigging, hence have no right to make key decisions.
