Trump, according to Cheung, must continue the Presidential Transition process, and critical duties should be performed to stop interference.
Cheung in a statement said, “The Constitution requires the immediate dismissal of this meritless case.”
Cheung said that “there should be no sentencing.” He further added, “Trump will fight these hoaxes until they are completely dismantled.”
Before this, Trump had faced two federal cases by the special counsel Jack Smith. Those two cases were also dropped in line with Justice Department protocol.
The policy prohibited the prosecution of a sitting president during Trump’s presidency. He was indicted once for scheming to steal the 2020 election, which Joe Biden ultimately won.
Charges in the other case included theft of a substantial amount of secret documents when leaving the White House.
Though both cases received widespread attention, they were eventually abandoned during Trump’s presidency.
Georgia State Elections
Another charge against Trump is racketeering in Georgia for allegedly trying to rescind the state’s election results in 2020.
The alleged crime and state law surrounding Georgia’s election results charges indicate that Trump and his campaign supporters had conspired to influence the latter.
Most legal analysts expect the Georgia case to be put on hold until Trump’s White House term subsides.
There is this lacuna to allow a president to continue his/her term without any legal hurdle.
Trump has dismissed all the allegations, labeling the investigations as political attacks meant to weaken his administration.
In his efforts to ensure that elections are free and fair throughout the country, he insists that his actions were lawful.
Cheung confirmed that Trump’s determination to battle what opponents perceive as politically motivated cases against him increased.
“These witch hunts are baseless, and President Trump will prevail,” Cheung said confidently at the end of his speech.
The legal issues are still quite serious, and experts anticipate that further actions will spark intense discussion and attention.
